Attorneys for Balfour tried to throw out the arrest, as well as evidence from what they believe was a warrantless search.

Balfour is accused of the 2008 killing of Hudson’s mother, Darnell Donerson; brother, Jason Hudson and 7-year-old nephew Julian King, allegedly because he suspected his ex, Julia, was in a relationship with another man.

Last week, Balfour’s attorneys said they wanted to meet with Hudson before their client’s trial begins in April, in case the star singer and actress is asked to take the stand.

Balfour is next expected to appear in court on Feb. 23rd, his trial begins on April 9th.
