The suspect who punched a white man in NYC’s Union Square, resulting in his death, is being held on an assault charge, but investigators say those charges might change.

Lashawn Martin, 31, was arrested and charged with beating Jeffrey Babbitt into a coma after declaring that he would punch the next white person he saw.

On Monday, the 62-year-old Brooklyn man died from cardiac arrest.

According to CBS:

Because of Marten’s alleged comments about targeting white people, the incident could result in hate crime charges in addition to felony assault charges, according to Police Commissioner Ray Kelly.

The NYPD’s hate crimes unit is investigating. Marten is being held on an assault charge, but upgraded charges are possible.
