Comedian Tracy Morgan is suing Wal-Mart for negligence in connection to the tragic June 7th car crash that he and James McNair (who was killed), were involved in.

According to reports, the man operating the truck, Kevin Roper, had been awake for a little over 24 hours before the accident happened. Roper reportedly fell asleep behind the wheel as he collided onto a limousine van on the New Jersey Turnpike, the vehicle that Tracy and friends were riding in.

Papers filed in the U.S District Court of New Jersey state:

Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries. As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.

The lawsuit against the retail empire also cites that, “Wal-Mart knew, or should have known,” that Kevin Roper was awake for more than 24 hours before the crash.

 

After the accident, Wal-Mart has sent out their deepest apologies in a public statement:

We are deeply sorry that one of our trucks was involved. We’re committed to doing the right thing for all involved.

Tracy is currently in a rehab center and showing “signs of improvement” according to Gossip Cop. We will keep you posted on the latest.
