Walmart has settled a wrongful death claim with the family of a comedian who lost his life in the New Jersey crash that also seriously injured celebrity Tracy Morgan last summer.

This is the first settlement since the incident in which a Walmart truck ran into a van carrying Morgan and three others, including James McNair, who was killed.

The settlement between Walmart and McNair’s family is undisclosed but according to the family’s attorney, Daryl Zaslow, they are content with the results.

Wal-Mart “caused extensive damage” to the family but accepted responsibility and “more than stepped up to the plate and took care of this family,” Zaslow said.

“Ultimately they did the right thing by the McNairs,” he said.

Walmart came to an agreement before the claim reached a lawsuit and admitted no liability in the crash.

Passengers Ardley Fuqua, Jeffrey Milea, and Morgan suffered serious injuries, with Morgan sustaining a traumatic brain injury. Fuqua, Milea, and Morgan have all filed lawsuits against Walmart.

Kevin Roper was driving 65 mph before slamming into Morgan’s van. The driver had been operating the truck without sleeping for 24 hours. Roper has been charged with death by auto and four counts of assault by auto.
