The death of a three-year-old found unresponsive on a swing in Maryland has been ruled a homicide, NBC Washington reports.

Charles County Sheriff’s Office released information about the May incident involving Romechia Simms and her son Ji’Aire Donnell Lee this week. The child was put in a swing at a LaPlata-area park on May 20 and found dead (with his mother still pushing him) two days later.

Simms, who suffers from bipolar disorder and depression, says she doesn’t remember the incident.

The Chief Medical Examiner in Baltimore ruled the death a homicide after determining baby Ji’Are died of dehydration and hypothermia. No trauma was found on the boy’s body. Charles County Sheriff’s Office spokesperson Diane Richardson stated the weather was fairly chilly for May, with temperatures in the mid 50s.

Simms and the child’s father, James Lee, comforted each other and held hands during Ji’Are’s funeral in early June, NBC reports.

At her son’s funeral, 24-year-old Simms–who was hospitalized for four days following her son’s death–sang ‘This Little Light of Mine’ along side the boy’s father, James ‘Donnell’ Lee, 29, and other mourners in early June.

At the time of the child’s death, Lee says Simms was unfit to be a mother. Simms was staying at a motel with Ji’Are days before he died.

No charges have been filed against Simms in the ongoing investigation.
