Following a hearing on Tuesday, a Pennsylvania judge has ordered Bill Cosby to stand trial on sexual assault charges.

Sections of accuser Andrea Constand‘s statement were read in court, detailing the sexual assault that took place in Cosby’s home in 2004. In the statement, Constand says she was dealing with personal issues and Cosby gave her pills to help her relax. BBC reports the pills made her “dizzy” and her legs became “like jelly.” Cosby then reportedly proceeded with sexual contact. According to his statement, Cosby said at no time did Constand ask him to stop during the incident.

“The evidence presented today was evidence of nothing. They had 12 years to bring an accuser to confront Mr. Cosby. They chose not to,” said the actor’s defense attorney, Brian McMonagle, CNN reports.

He continued, “There was no evidence of a crime here. And the inconsistencies that plagued this investigation from the beginning continue to plague it now. This case should end immediately.”

Cosby faces counts of felony aggravated indecent assault from the 2004 case involving Constand. He will begin trial on an undetermined date. He could face up to 10 years in jail.
