The battered model took a small loss in court yesterday when a family court judge denied a motion to lift the emergency restraining order that was issued against him on the day he got beat up by Halle's fiance Olivier Martinez.
So for now, Gabe has to stay away from both his daughter and Halle until November 29th.
Halle and Olivier have until Thursday to file if they would like to extend the restraining order, but Gabriel is already playing his next legal hand to disrupt the flow of their life in their nasty custody battle.
Gabriel wants criminal charges brought up against the Unfaithful actor for the beating he unleashed on the model's face.
Radar Online reports:
"Gabe wants criminal charges brought against Olivier for beating the living daylights out of him on Thanksgiving," a source close to the situation tells Radar. "Gabe can't believe that he was the one arrested when he says he did absolutely nothing to provoke the attack. If you look at the pictures of Gabe's hands after the fight, there isn't one scratch, nor did he suffer any wounds to his hands, as Olivier did. Gabe says he was rendered defenseless because he was knocked to the ground by Olivier's punches. Remember, Olivier's father was a former professional boxer and he has trained for years also."
While Gabe was cuffed after the fight, criminal charges against him are highly unlikely since the consensus is that the fight was "mutual combat."
