Kansas City woman Shanta Russell had been taking a birth control pill by Qualitest Pharmaceuticals for over 12 years, so she was extremely surprised when a pregnancy test she took back in June of 2011 came back positive. 

Then, about three months later, Qualitest sent her a recall notice in the mail that stated that her pills had been packaged in the wrong order and were, therefore, ineffective.

The pills were rearranged, so that the pills a woman is supposed to take during her period were placed where the pills containing hormones should’ve been. 

Russell had her daughter earlier last year and recently filed a lawsuit against both Qualitest and the company that packaged their product. She is seeking cobmpensation for emotional pain she endured as a result of the unwanted pregnancy, expenses associated with raising the child, and healthcare costs. 

Russell was very focused on her career and believed she did not have time for a child, at the moment she found out about the pregnancy. However, she did not want to have an abortion, so she chose to follow through with the pregnancy.

“I was devastated,” Russell said. “I questioned myself. After all these years, how could this happen? Then I received a letter in the mail. Of course I was angry. There was nothing I did that was a mistake.”

Qualitest has also been sued by women in California, Texas, and Tennessee who became pregnant as a result of the company’s mistake.
