DETAILS: Instagram Is Straight Flexin’ With Their New Policy

After numerous celebrities and users voiced their opinions about the breach of privacy posed by the new terms, a complaint filed might really be the demise of the company.

Lucy Funes, Instagram user, filed a complaint in a San Francisco federal court saying that she believes the updated terms of service breach contract and California business law.

“If customers do not agree with Defendant’s scheme, they can cancel their profile with Instagram. However, upon canceling, customers forfeit all right to retrieve the Property that was previously entrusted to Instagram, which retains rights thereto in perpetuity. In short, Instagram declares that ‘possession is nine-tenths of the law and if you don’t like it, you can’t stop us.”

Even though the new terms won’t take effect until mid-January, it includes a mandatory clause that forces users to waive their rights to participate in a class action lawsuit except under very limited circumstances.

Facebook spoke on Funes’ complaint and doesn’t seem to be worried:

“We believe this complaint is without merit and we will fight it vigorously.”

If more suits follow, looks like the social media giant might see some bad times. Which sucks for us because how else will we see pictures of Breezy and RiRi?
