NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The Global Grind “Ride Along Set Visit” Sweepstakes (“Sweepstakes”) starts at or after 11 AM Eastern Time (“ET”) on November 17, 2012 and ends at 11:59 AM (ET) on November 28, 2012 (“Entry Period”). The sponsor of the Sweepstakes is GG Digital, Inc. (“Global Grind”), New York, NY 10018 (the “Sponsor”). The Sweepstakes shall be subject to these Official Rules and by entering, all participants agree that they have read these Official Rules and to abide by and to be bound by the terms and conditions herein. False and/or deceptive entries or acts shall render entrants ineligible.
ELIGIBILITY: SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, TWENTY-ONE (21) YEARS OF AGE OR OLDER AS OF DATE OF ENTRY.
Persons who have won a prize in another Sweepstakes, Giveaway or promotion of any kind from Sponsor within the ninety-day (90) period immediately preceding the start date of this Sweepstakes are not eligible to participate.
Employees of the Sponsor, Universal City Studios, LLLP (“Prize Provider”), and their respective parent companies, affiliates, subsidiaries, and related companies and agencies (collectively, the “Promotion Parties”), and their immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the household of same, whether or not related, are not eligible to enter or win.
PRIVACY INFORMATION: The personally identifiable information you provide on the Entry (as defined below) will be collected, stored, used, and shared in accordance with the Sponsor’s Privacy Policy available at http://globalgrind.com/privacy-policy, subject also to the policies of Twitter, Inc.
The laws of the State of New York apply to and govern this Sweepstakes and any claims must be raised and resolved in the federal or state courts located in New York County, State of New York. By participating, you agree to the personal jurisdiction of such courts. To the fullest extent allowed by law, any claims must be brought individually (not as part of a class action) and an individual’s recovery shall be limited to his/her actual out-of-pocket costs in entering the Sweepstakes, with all other damages, relief or remedies being expressly waived.
Void in Puerto Rico, all U.S. territories and possessions, overseas military installations and where prohibited or restricted by law.
HOW TO ENTER THE SWEEPSTAKES: You must be a registered member of Twitter in order to participate in the Sweepstakes. (Membership on Twitter is free.)
During the Entry Period, members of Twitter may enter by logging into their Twitter account and sending a tweet using the hashtag #ridealong (“Entry”).
ONLY ONE (1) ENTRY INTO THE SWEEPSTAKES PER PERSON AND/OR TWITTER MEMBER ACCOUNT PER DAY WILL BE ACCEPTED. ANY ATTEMPTED ENTRIES IN EXCESS OF THAT LIMIT SHALL BE DEEMED VOID. VIOLATION OF THE ENTRY LIMIT MAY ALSO RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES.
All tweets/entries must comply with Twitter’s Terms of Service and all other applicable Twitter guidelines. By way of example only, hashtag should only be used for purposes of participation in the Sweepstakes as per these Official Rules (all other use of hashtag is prohibited); a given person should only use one (1) Twitter account to participate in the Sweepstakes.
All entries must be solely the original work of entrant. Entries must not (a) violate or infringe upon the rights of any third party, including rights of trademark or copyright; or (b) be inappropriate for publication (e.g., obscene or vulgar); if Sponsor determines in its sole discretion that an entry is in violation of either of these criteria, entry will be disqualified. ENTRIES REFLECT SOLELY THE VIEWS AND OPINIONS OF ENTRANTS SUBMITTING THEM, NOT THOSE OF SPONSOR OR ANY OF THE RELEASEES (AS DEFINED BELOW); SPONSOR AND RELEASEES FURTHER DISCLAIM ANY AND ALL LIABILITY IN CONJUNCTION WITH ANY STATEMENT MADE IN ANY TWEET SUBMITTED AS AN ENTRY IN THIS SWEEPSTAKES.
Entrants grant the Sponsor and its designee(s) the unconditional and perpetual right, world-wide license, and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, creative derivative works of, exhibit and otherwise use the tweet/entry (with or without any attribution of any kind) in any media throughout the world for any purpose, without limitation, and without additional review, compensation or approval by entrant.
The Promotion Parties, Internet server(s), Internet provider(s), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents, as well as Twitter, Inc. (collectively, “Releasees”) are not responsible for: any incorrect or inaccurate Entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access any email connection or web page, theft, tampering, destruction, or unauthorized access to, or alteration of Entries; Entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or on any web site or email address or due to the filtering technology utilized by Twitter, Inc.; printing or other errors; and any Entries which are late, lost, incomplete, misdirected, stolen, undelivered, mutilated, illegible, or any combination thereof; or theft or destruction or corruption of Entries. Proof of submitting an Entry is not considered proof of delivery or receipt. Illegible and incomplete Entries will be disqualified. All Entries become property of Sponsor and will not be acknowledged or returned.
WINNER SELECTION: One (1) prospective prize winner will be selected in a random drawing from among all eligible Entries received. Random drawing will be conducted on/about 11/29/12 by representatives of the Sponsor or its designee, whose decisions are and shall be final and binding in all matters relating to this Sweepstakes. Prospective prize winner will be notified by direct message to their Twitter
account (and, prospective prize winner’s account settings must allow for Sponsor to contact them via direct message ). Such notification will occur approximately 24 hours after selection in drawing. Such winner will be required to respond to this notification verifying eligibility within 24 hours, or his/her prize may be forfeited and an alternate winner selected at Sponsor’s sole discretion (time permitting).
Grand Prize winner will be required to execute and return a notarized Affidavit of Eligibility/Release of Liability and (except where prohibited) a Publicity Release and a completed IRS W-9 form within indicated time period.
Grand Prize winner’s
travel companion is required to be twenty-one (21) years of age or older as of Grand Prize winner notification, and will be required to execute and return a Release of Liability and (except where prohibited) a Publicity Release form within indicated period.
If a prize notification or prize is returned as undeliverable for any reason, or if prize winner is not in compliance with the terms and conditions stated in these Official Rules, the prize may (at Sponsor’s sole discretion) be awarded to an alternate winner from among all remaining eligible entries received for the random drawing (time permitting). Prize is not transferable, assignable, or redeemable for cash. No substitution for the prize by the prize winner will be allowed. Prize must be accepted as awarded. If necessary, due to unavailability of the prize or parts thereof for any reason, a prize of comparable value will be awarded at the sole discretion of the Sponsor (as applicable).
All Federal, state and local tax liabilities are the sole responsibility of the winner. Acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use the winner’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation.
PRIZE: GRAND PRIZE (One [1]): The Grand Prize consists of a trip (“Trip”) for two (2) people to Atlanta, GA (“Atlanta”) and the opportunity to visit the set of the movie “Ride Along” and meet and greet members of the cast of “Ride Along” (“Set Visit”). The Trip includes the following: (i) roundtrip economy class air travel for two (2) from the major U.S. gateway airport nearest the winner’s hometown to an Atlanta-area airport (selected by Sponsor), (ii) two (2) consecutive nights’ accommodations (single standard room, double occupancy, room and tax only) at an Atlanta-area hotel (“Hotel”), (iii) ground transfers between airport and Hotel in Atlanta area, $300 spending money.
Specific air carrier(s), airport(s), Hotel and other Trip specifics detailed above are at the sole discretion of the Prize Provider. The approximate retail value (“ARV”) of the Grand Prize is $2,500. The actual value of Grand Prize travel may vary depending on city of departure, date and times of travel, airfare fluctuations and Hotel charges at the time of travel booking. Actual value of the Grand Prize awarded may be lower or higher at the time it is fulfilled. Any difference between actual value and stated ARV will not be awarded. If Grand Prize winner elects to travel without a travel companion, no additional prize element will be substituted nor will winner receive any compensation in conjunction therewith. If the Grand Prize winner’s residence is within one hundred fifty (150) miles of Atlanta (as determined by Prize Provider in its sole discretion), air travel portion of Trip will not be awarded and no additional prize element substituted nor will winner receive any compensation in conjunction therewith. All travel is subject to the following restrictions and conditions: Grand Prize winner will be required to travel on dates determined at the sole discretion of Prize Provider (tentatively between Monday, December 10, 2012 and Friday, December 14, 2012). If winner is unable to travel during dates determined by Prize Provider as necessary to attend the Set Visit, prize will be forfeited and an alternate may (or may not) be selected at Sponsor’s sole discretion (time permitting). All travel elements are subject to holiday and blackout dates and availability. All meals, gratuities, excursions, additional ground transfers, insurance, fees, surcharges, service charges or passenger facility charges, incidentals, departure and airport taxes, and any other expenses not specified herein are the sole responsibility of the Grand Prize winner and his or her travel companion. All travel arrangements are to be administered by Prize Provider. Travel must originate and end at the same major U.S. gateway airport.
Grand Prize winner and his or her travel companion will be required to travel on identical itineraries including the same departure date, destination and return date. Grand Prize winner and his or her travel companion will be required to provide valid government issued photo ID at time of travel as required by airport, airline and government authorities. No changes will be made to travel details once any element(s) of the travel arrangements have been booked. No frequent flier miles or other perquisites (e.g., hotel loyalty rewards points) will be earned on any element of prize travel. Prize conditions may be added or modified by Prize Provider. Releasees are not responsible for any changes of any element of Trip, including but not limited to changes in schedule or unavailability of Set Visit. In the event the Set Visit portion of the Grand Prize is canceled or rescheduled for any reason, the remainder of the prize shall constitute the complete and total prizing for the Sweepstakes and no additional prize element will be substituted nor will winner receive any compensation in conjunction therewith. (For the avoidance of doubt, Set Visit portion of Grand Prize has no retail value). Grand Prize winner and travel companion must conduct themselves at all times in a responsible, appropriate and courteous manner during Set Visit. Sponsor and Prize Provider make no representation or warranty that any specific actors or other individuals will be available during Set Visit. Releasees are not liable for any expenses incurred as a consequence of flight cancellation or flight delays. Neither Sponsor nor Prize Provider will replace any lost or stolen tickets, travel vouchers or certificates.
No stopovers are permitted on tickets issued as a prize; if a stopover occurs, the prize will terminate and full fare will be charged from the stopover point for the remaining trip segments, including the return. Once Hotel and flight arrangements have been confirmed, no changes will be allowed except by Prize Provider.
An unclaimed and/or unused Grand Prize travel package will remain the property of Sponsor or its designee.
The odds of winning the prize are determined by the total number of eligible Entries received.
LIMITATIONS ON LIABILITY: Releasees shall not be liable to the winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Releasees’ sole control. Releasees shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Releasees shall not be liable for any loss or damage to baggage.
GENERAL: By entering this Sweepstakes, entrants agree that Releasees shall not be liable for personal injuries, death, damages, expenses or costs or loss
es of any kind resulting from participation or inability to participate in this Sweepstakes or acceptance of or use or inability to use the prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner releases the Releasees from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death). Winner acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.
If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any email address, web site or service associated therewith (or any portion(s) thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of Entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor will conduct a random drawing to award the prize from among all eligible, non-suspect Entries received prior to the time of the action or event warranting such cancellation or otherwise in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. If such cancellation, termination, modification, or suspension occurs, notification will be posted here.
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR EMAIL ADDRESS OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
If a dispute arises about who submitted an Entry, the Entry will be deemed submitted by the authorized account holder of the email account associated with the Twitter account used to enter the Sweepstakes. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning Entry and that all eligibility requirements are met.
NOTE: Entry must be made by the entrant personally as set forth above. Entries made by any other individual or any entity, and/or originating at any other web site or email address, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device or software to automate the Entry process is prohibited.
