Madonna is heading to court.  

A company out of Delaware called VMG just filed a lawsuit against Madonna and her record company, WB Records.

VMG claims that Madonna’s 1990 hit “Vogue,” sampled portions of a composition called “Love Break,” a track that was released in 1977.

The suit claims that “Vogue” purposely hide portions of the song that were sampled and “which have been copied into Vogue and all its various mixes, remixes videos, YouTube versions, etc.”

VMG claims that they were able to find out their song got ripped off using technology that only became available last year. 

The company says they gave Madonna and WB Records a notice of copyright infringement in July 2011 and again in February 2012. 

Now they are taking it to court, asking for damages on top of profits Madonna made from the song.

The legendary singer has yet to comment.
