Lawyers representing Nick Gordon have asked a judge to dismiss the lawsuit filed against him in the death of Bobbi Kristina Brown.

The motion was filed on Tuesday, 11Alive reports. Gordon’s criminal lawyer Jose Baez called the claims “slanderous and meritless,” after the lawsuit claimed the 25-year-old created a “toxic cocktail” for Brown and placed her face down in the bathtub of her Atlanta, Ga. home in January.

Accusing Gordon of assault, battery, intentional infliction of emotional distress, and transferring money from her account into his own without authorization, the Brown/Houston family is looking to collect $10 million in damages.

Baez and rest of Gordon’s team insist the case be dismissed because Gordon isn’t a resident of Georgia, and his recollection of the day Bobbi Kristina was found in the bathtub is different from the family’s claims.

Supporting documents include Nick’s side of the story, stating, “the parties went out on the night in question, then he (Gordon) reviewed video footage and then had an argument with Ms. Brown and that he changed clothes. Defendant denies the remaining allegations…”

In the docs, Gordon claims “that someone went into the master bedroom and found Ms. Brown face down in the bathtub, and that Ms. Brown appeared unconscious and unresponsive at that time. Defendant denies the remaining allegations…”

Gordon claims he tried to wake up the 22-year-old by performing CPR. His lawyers also state there was no actual proof of the claims the family alleges. Bobbi Kristina was found unconscious in her bathtub on Jan. 31. She never regained consciousness and died July 26.

The lawsuit was filed in June and later amended after Brown’s death.
