Republicans in the Arkansas House of Representatives have approved a bill that bans abortions after 12 weeks of pregnancy if the fetus has a heartbeat. Although the law has not been passed, it is expected to exclude incidents of rape, incest, lethal fetal disorders and health threats to the mother of the child. If passed, this will be the most extreme abortion restriction to date.
Not all are in favor of the “heartbeat bill.” Some argue that the bill does not consider the grace period in which mother’s actually find out they are pregnant. President and CEO of the Center for Reproductive Rights, Nancy Northup, is one of those who oppose the bill.
“Let’s call this bill what it is: bumper-sticker message legislation with no chance of standing up in court, designed to dial the clock back 40 years on women’s rights. This extreme ban will either force women already facing tough economic circumstances to travel to a neighboring state to access constitutionally protected health care or to turn to dangerous, clandestine options that could ruin or even end their lives.”

The “heartbeat bill” isn’t the only shot fired at women’s rights to abortion. The House Public Health, Welfare and Labor Committee also approved a bill that bans abortions at 20 weeks after conception. Both the “heartbeat bill” and the 20 week “baby gotta stay” bill defy the Supreme Court’s decision in Roe v. Wade, which prevents states from banning abortion before the fetus is viable: 22-24 weeks after gestation.
Both bills advance to a full House vote this week. Arkansas Governor Mike Beebe has expressed his concerns, but has not expressed whether or not he is in favor of the unconstitutional bills.
Women have fought for their right to decide when motherhood is right for them. Margaret Sanger, the woman who fought for these very rights, must be turning in her grave.
