The attorney for 24-year-old Jonathan Ferrell’s family is giving a play-by-play account of what he witnessed on the police dash cam before the former college football player was unnecessarily shot – and it’s not looking good for the police department.

Attorney Christopher Chestnut told the Charlotte Observer that Ferrell, who was seeking help after crashing his car in a suburban Charlotte, NC neighborhood, showed cops that he was unarmed.

But when he started to move, they shot at him 12 times (hitting him 10 times) without warning.

As two red laser dots from stun guns flashed on his chest, Jonathan Ferrell hitched up his pants and held out his arms to show officers he was unarmed, his family’s attorney told the Observer on Tuesday.

Ferrell then ran sideways on a dark road in northeast Charlotte Saturday, said the attorney, Chris Chestnut.

After changing positions, Ferrell went out of view of the police cruisers’ dashboard camera. That’s when the gunshots rang out.

“It’s one, two, three, four – pause,” said Chestnut, counting off the shots he heard. “One, two, three, four, five, six – pause. One, two.”

Chestnut said that’s when he heard officers yell “Get down.”

Not once did Officer Randall Kerrick, who was charged with manslaughter for killing Ferrell, warn the victim before firing.

Chestnut’s account of the footage is the most detailed description of what happened that tragic night. He says the video is clear evidence that Ferrell was not a deadly threat and that the shooting was not justified.

But Kerrick’s attorney, Michael Greene, is saying that the shooting was legal.

“We’re confident at the resolution of this case it will be found that Officer Kerrick’s actions were justified on the night in question,” Greene said.

But if he’s basing that on Kerrick’s word alone, they are going to have some problems.
