A man who was caught on camera sleeping at a Yankee game has brought a defamation lawsuit against Major League Baseball, ESPN, and game announcers, demanding $10 million for emotional distress.

Andrew Robert Rector is suing ESPN’s Dan Shulman and John Kruk, whom Rector claims defamed him by calling him a “fatty” after he was caught on camera sleeping during a Yankees game on April 13. Rector sued the ESPN anchors in a Bronx Supreme Court last Thursday, claiming they released “an unending verbal crusade” after cameras captured him dozing off at the Yankees vs. Red Sox game. Rector says his character was defamed and claims he suffered emotionally.

The lawsuit, which is littered with typos, states that millions of people “all over the world” were watching when Shulman and Kruk poked fun at him. The lawsuit goes on to say the anchors hurled an “avalanche of disparaging words” such as “stupor, fatty, unintelligent and stupid” to describe Rector.

However, a YouTube clip taken during the game of Shulman and Kruk lightly joking about a snoozing Rector doesn’t include any of those put-downs stated in the lawsuit.

Rector’s lawyer declined to comment when questioned.
