Romechia Simms, the Maryland mother who was found pushing her dead son on a swing for two days earlier this year, has been charged with manslaughter and first-degree child abuse, BuzzFeed reports.

Ji’Aire Donnell Lee‘s death was declared a homicide in July, after a medical examiner cited the 3-year-old’s cause of death as dehydration and hypothermia. The Charles County State’s Attorney’s Office said Simms, 24, placed her son on the swings of Wills Memorial Park in late May. She remained in the park for two days, instead of returning to the motel nearby where she was staying with her mother. After receiving a phone call from an eyewitness, police arrived on the scene. Officers tried to save the child, but he was already dead.

Vontasha Simms told reporters her daughter has bipolar disorder and a history of depression.

Ji’Aire’s father, James Lee, had been fighting for full custody 11 days before the child died. He told reporters Simms showed signs of troubled behavior and paranoia. She even allegedly jumped out of a moving cab with her son. However, when Lee was asked in court if Simms was a harm Ji’Aire, he said no. Simms was eventually awarded custody of the boy throughout the week, while Lee watched him on weekends.

Romechia Simms was also charged with second-degree assault following altercations with her mother in 2011 and 2012. She was found not guilty in each instance.
