The incident happened early Friday morning when the 52-year-old woman, identified as Julie, told Johnny Max Mount, 45, to put out his cigarette, which he refused. During the argument, Mount pulled out a 9 mm handgun from under his shirt and shot her in the head.

Kelly Thrasher-Bruner, a spokeswoman for Waffle House, Inc. tells The Chicago Tribune the Biloxi location has a no-smoking policy.

The waitress died on the way to the hospital.

Mount surrendered without incident and was charged with first-degree murder. He is currently being held on a $2 million bond. Police only released the woman’s first name in respect of finding her family. Julie has worked for the restaurant chain for eight years.

Hours after the shooting, the restaurant was open to the public.
