Comedian Tracy Morgan is finally in fair condition this week, following a car crash that left him in critical condition and a fellow comedian dead.

His representative, Lewis Kay, confirmed Morgan’s improving health on Monday.

“Happy to pass along that Tracy has been upgraded to fair condition, which is a great improvement,” the statement reads. “His personality is certainly starting to come back as well.”

According to the statement, Jeff Millea, Morgan’s 36-year-old assistant who was also in critical condition after crash, has been upgraded to fair condition as well.

Kay said the medical team remains optimistic about his recovery and condition.

If you recall, Morgan suffered a broken nose, broken femur and broken ribs after a Walmart tractor-trailer struck the SUV limo he and several others were riding in on June 7. Morgan was just leaving a standup comedy date in New Jersey when the accident occurred.

Kevin Roper, the driver of the truck, was charged with vehicular homicide and assault by auto. He pleaded not guilty to the charges during an arraignment last week.

If convicted, he faces up to 15 years behind bars.
