A teenager used his first defensive instinct yesterday as he shot what he thought was an intruder in his home in Florida.

The person he shot turned out to be his 12-year-old brother, who was later pronounced dead at the hospital after the accident.

Realizing his mistake, the 16-year-old teen called the police immediately to report the incident.

Mike Moreschi told WFTV about the scenario:

‘He heard some noises and he called out for his brother and he didn’t answer and so then his brother startled him.”

Since the teen shot him as a defense mechanism, he will not be charged with the murder of his little brother.

Apparently the gun was legally owned, but no sources have revealed as to how the teen got his hands and had access to it.
