The driver of the train that killed 79 in Spain and left 15 in critical condition was talking on the phone and reading at the time of the crash, a court revealed.

Francisco Jose Garzon de Amo, 52, was traveling at 95 mph, almost double the 50 mph speed limit on a curve heading into the city of Santiago de Compostela. Allegedly, he was going at 120 mph just before that. He only pushed on the breaks “seconds before” the train flew off the rails and went up in flames.

Investigators say Garzon was speaking with Renfe, the state rail company, and consulting a paper document at the time of the crash. He has been charged with negligent homicide.

State officials are inspecting the train tracks and security systems to see if they could have played a part.
