The woman who is serving 20 years behind bars for firing a warning shot to scare off her abusive husband may go home today.

A Florida judge is expected to decide if Marissa Alexander will be released on bond as she awaits her new trial. Last month, the court ruled that the case will be retried because the jury had incorrect directions and many believed her sentence to be too harsh.

According to CNN, Alexander is hopeful about the possibility of seeing her children as she waits for her new trial.

The lawyer for Alexander’s estranged husband, Rico Gray, has concerns, however.

“She had bond once on this case and she went over to my client’s house and she gave him a black eye, and got arrested, though she was told to stay away from my client, so I don’t think he necessarily wants her to have a bond again,” said Richard Kuritz, Gray’s attorney.

The hearing is set for 4 p.m. ET Wednesday. We’ll keep you updated on the latest.
