Imagine having a twin that committed a horrible crime, and you got the punishment for it.

Well, that might be the case for Ductrung Tong, who was recently charged with the murder of a 22-year-old man after he was stabbed to death at a birthday party.

According to The Huffington Post, the 18-year-old student was initially being charged with murder for the crime, but prosecutors believe the real suspect is his twin brother.

The two have been in custody since Jan. 26.

Ductrung Tong had been charged with murder, but those charges were amended in Santa Clara Superior Court Wednesday. He will now be tried as an accessory to murder. His brother, Anh Tong, now faces murder charges.

Legal analyst Steven Clarke told the site of the case:

“A jury is going to look at this case now with some skepticism because the prosecution’s theory has completely shifted by changing their theory from one twin to the other.”

Unfortunately, the victim behind the stabbing was murdered while he was trying to break up a fight. There’s no official word on how this case will play out just yet.
